After two years of fighting this notorious spammer through the U.S. courts, BiblioTech Ltd., a London, UK, based company successfully reached a landmark settlement agreement on 27 March 2000. While Khuri offered to settle earlier, we were not satisfied until the result would achieve our objective--making him liable for spamming anyone, not just us. As part of the agreement, Khuri and Benchmark Print Supply are liable for damages anytime they spam anyone, anywhere. If you have been a victim of his spam, all you have to do is claim for damages. Of course, make sure to not delete the evidence (the spam).

Here is a brief summary of the steps to take when you've been spammed from Sam Khuri/Benchmark Print Supply. The details of the case are as follows:

Sam Khuri, the main defendant in this case, signed a settlement agreement on 27 March 2000. The main effect of the agreement is that Khuri will be liable to pay liquidated damages of $1,000 plus legal fees to the relevant party (which may include any Internet user or ISP) every time that he does any of the following in the future:

(a) he sends or assists others to send unsolicited commercial e-mails that do not bear the true originating e-mail address

(b) he sends or assists others to send unsolicited commercial e-mails that do not allow recipients to opt-out from further marketing e-mails

(c) he sends or assists others to send unsolicited commercial e-mails to individuals that have opted-out from marketing e-mails

(d) he disguises or eliminates the actual originating address of an unsolicited commercial e-mail to make impossible or difficult the identification of the actual sender

(e) he sells or distributes e-mail addresses of Internet users that have not expressly requested to receive unlimited commercial e-mails.

BiblioTech's London attorney has suggested that complaintants channel damage filings through our US attorney in the case (as, in order to claim the liquidated damages, it is necessary to do so by reference to the judge order sanctioning the settlement agreement with Khuri). His details are:

The reason why we suggest that third parties contact Pete Wellborn is because in order to claim the liquidated damages, it will be necessary to do so by reference to the judge's order sanctioning the settlement agreement with Khuri and if Khuri refuses to pay, it may also be necessary to file suit under the settlement agreement. So, it would be easier to do it through someone that knew what to do.
